This policy applies exclusively to individuals interacting directly with the 10z Creators website, the Creator dashboard, our application process, and our technology infrastructure.
Platform Liability Shield: This policy does not apply to end-users or audiences consuming 10z Creators syndicated content on third-party platforms (e.g., YouTube, Meta, TikTok, Snapchat). When consuming content on those platforms, audience data is governed strictly by the respective privacy policies of those third-party platforms. 10z Creators does not control, and is not liable for, the data collection practices of third-party distribution platforms.
2. Information We Collect and Legal Basis (GDPR & Global Standards)
We process data under the following legal bases to operate our creator network:
- Creator Onboarding & Financial Data (Contractual Necessity & Legal Obligation): To pay you and enforce our licensing agreements, we collect your name, email, physical address, banking details, and tax identification information (e.g., W-8BEN/W-9 data, VAT numbers). We also collect government-issued ID for Know Your Customer (KYC) and Anti-Money Laundering (AML) compliance.
- Platform API & Metadata (Performance of Contract / Legitimate Interest): To ingest, optimize, and syndicate content, we authenticate with third-party platforms. Google API Services Compliance: 10z Creators utilizes YouTube API Services. 10z Creators' use and transfer to any other app of information received from Google APIs will strictly adhere to the Google API Services User Data Policy, including the Limited Use requirements.
- Biometric Data & Content Localization (Explicit Consent / Contract): If you opt into our content localization, dubbing, or AI-avatar syndication services, we may process voiceprints or facial geometry solely for the purpose of translating and distributing your likeness in other languages.
- Communications (Legitimate Interest): We may record video conferences and strategic calls (e.g., Zoom) for quality assurance, deal documentation, and relationship management.
- Automated Information & Cookies (Consent): Device information, IP addresses, and tracking pixels are collected. Non-essential tracking (marketing/analytics) is only processed upon your explicit consent via our Cookie Banner.
3. How We Use Your Information
We do not sell Creator contact data. We use collected information to:
- Ingest, localize, and syndicate content across platforms and distribute revenue shares.
- AI & Algorithm Development: Develop, test, and train proprietary distribution algorithms, machine learning models, and content optimization workflows using platform analytics, A/B testing data, and metadata. (Note: We do not use your personal identity data to train generative AI without explicit, separate licensing agreements).
- Conduct KYC/AML identity verification to prevent financial fraud.
- Aggregate and anonymize Audience performance data to secure brand sponsorships and negotiate higher ad rates.
4. Data Sharing and Subprocessors
We share information strictly to operate our business and fulfill our contracts:
- Infrastructure: Our core databases are hosted on secure cloud servers (e.g., AWS) in the European Union and the United States.
- Financial & Legal Providers: We share necessary data with payment gateways, tax authorities, and legal advisors to facilitate creator payouts and ensure regulatory compliance.
- Brand Partners: We share purely aggregated, non-personally identifiable viewership demographics with sponsors.
- Business Transfers (M&A): If 10z Creators is involved in a merger, acquisition, catalog sale, or asset transfer, creator data may be transferred as a business asset, subject to the protections of this policy.
5. International Data Transfers
10z Creators is headquartered in France. However, managing global creators requires transferring data outside the European Economic Area (EEA), particularly to the United States. When transferring personal data outside the EEA, we ensure adequate protection by utilizing the European Commission's Standard Contractual Clauses (SCCs) and ensuring recipients adhere to the EU-U.S. Data Privacy Framework.
6. Data Retention Periods
- Creator Financial/Tax/KYC Data: Retained for up to 10 years to comply with French, European, and US statutory auditing and tax laws.
- Creator Contracts & IP Records: Retained in perpetuity or for the duration of the copyright term to defend against chain-of-title and IP infringement claims.
- Marketing/Analytics Data: Retained for a maximum of 13 months, in accordance with CNIL guidelines.
7. European (GDPR/UK GDPR) & US Privacy Rights
- EU/UK: You have the right to request access, rectification, erasure, restriction of processing, and data portability. You have the right to lodge a complaint with the CNIL (France) or your local authority.
- US (CCPA/CPRA, etc.): Residents of applicable US states have the right to know what data is collected, request deletion, and opt-out of the "sale" or "sharing" of data for cross-context behavioral advertising.
